Land Tussle: Court places restriction over Ijehu community land disputeJustice Abiodun Adebara of  Offa High Court in Offa Local Government Area of Kwara State,   has granted an interim injunction, restraining the Olofa of Offa, Oba Mufutau Gbadamosi, his agents, privies,
servants, or anyone or person claiming title through or taking instruction from the Oba from further entering into the land at Ijehu
Community.

ROYAL NEWS gathered that the judge also restrained  the Olofa, his agents, privies, servants, or anyone or person claiming title through or taking instruction from the Oba from committing any act or further act of trespass on the land
or from dealing with the land in any manner adverse to the claimant’s/ applicant’s claim as a whole or any part thereof pending the hearing and final determination of the motion on notice in the case.

These were contained in  a court document  signed by the registrar of the court, Mr. Yinusa  Suleiman, which was made available to journalists in Ilorin, on Thursday.

The document  further explained that  the land is along Ikotun Road and  shares boundary with Igboidun Village, Ikotun, Ojoku and Ola’s compound, Offa, Kwara State.

Alhaji Moshood Adeogun   who is the  claimant/applicant,  had,  for himself and on behalf of the people of Ijehu Community, dragged  Olofa before the court in Suit No: KWS/OF/13/2018.

Adeogun’s counsel,  Mr. Surajudeen Bamidele, in an exparte motion prayed the court to restrain the Oba from trespassing into the land.

The  judge after listening to the argument  granted an interim injunction against Olofa and adjourned the matter till June 11, for
hearing of the motion on notice.

The judge ruled: “Upon perusing the motion ex-parte dated and  filed on 3rd day of April, 2018 along with the supporting affidavit of 32 paragraphs deposed to by Claimant/Applicant, and the attached
Annextures marked Exhibits “A-D”.

“Upon a careful perusal of the  further – affidavit of 13 paragraphs filed on 13th day of April, 2018 deposed to by Baba Tiamiyu Ajayi, an eldest member of the Ijehu Community and the attached Exhibits “E-G”.

Upon reading the accompanied written addresses of counsel and after listening to  S.A. ( Surajudeen Adekunle)  Bamidele Esq of Counsel to the claimant/aapplicant moving in terms of the motion

“It is accordingly ordered that: Interim injunction is granted restraining the defendant, his agents, privies, servants, or anyone or person claiming title through or taking instruction from the defendant
from further going into the land, the subject matter of this suit, which is lying being and situate at Ijehu Community which is along
Ikotun Road, Sharing boundary with Igboidun Village, Ikotun, Ojoku and
Ola’s compound, Offa, Kwara State and/or committing any act or further
act of trespass on the said land or from dealing with the land in any manner adverse to the Claimant’s/ Applicant’s claim as a whole or any part thereof pending the hearing and final determination of the motion on notice in this case.

“Consequently, the motion on notice is hereby scheduled for hearing againt 11th day of June, 2018. Given at Offa under the seal of the court and the hand of the presiding judge this 16th day of April,
2018.”
