Niger House of Assembly dissolves 25 LGs

The Niger state House of Assembly has dissolved the 25 local government councils in the state for non performance, misappropriation and have directed Governor Abubakar Sani Bello for the immediate implementation of the house resolutions to that effect.
The decision was taken at its plenary session ,ROYAL NEWS has gathered .
The House, while receiving the committee report chaired by Hon. Abdulmalik Muhammad Kabir representing Paikoro, directed the governor to conducto fresh elections within three months.
The motion as seconded by Hon. John Paul Bahago representing Munya constituency had directed the chairmen to handover the affairs of the councils to their respective Director of Personnel Management (DPM).
The Assembly unanimously accused the chairmen for their “failure to discharged their duties and functions under the Niger state Law, 2001 in a manner conducive to the welfare and well- being of the people of their areas of authorities”
They further said that the legislative councils have failed to hold meetings and sittings as required under Section 38; subsection (1) of Niger state local government Law, 2001 and not based on tenure for its dissolution.
Furthermore, during the lawmakers contributions it was discovered that non of the Councils legislative had ever seated for 50 times rather than 90 times per sessionh.
According to the lawmakers, the highest sitting were 47 in two years.
The House reminded that its only the state assembly who has the powers to determine the structure and management of the councils.
The legislators however expressed dismay over the Chairmen way of awarding contracts without due process and without approval of the legislative council enshrined under Section 75 subsection (1) of the Niger state local government law 2001 coupled with the several absence of the Chairmen from office.
It could be recalled that last week a High Court sitting in New Bussa has ruled against the Niger state government and its state assembly in the suit filed by the Social Democratic Party 14 other registered political parties , and 5 local government councilors over the reduction of the tenure of local governments in state.
The presiding Judge, Justice Mohammed Mohammed however ruled that the state house of assembly in particular lacked the power to amend the local government (amendment ) law 2016 of Niger state published as Niger legal notice No1 as it did to which Governor Abubakar Sani Bello appended his signature to make it become law.
