An Ogun State High Court sitting in Sagamu has issued a sweeping interim order restraining the state government from demolishing or tampering with properties belonging to former Governor Otunba Gbenga Daniel, pending further hearing.
The ruling, delivered in suit number HCS/371/2025, follows an affidavit of urgency filed by Daniel and his wife, Yeye Olufunke Daniel, after the state’s Ministry of Urban and Regional Planning issued contravention and quit notices on July 8 and August 8, 2025.
The affected properties include Daniel’s Asoludero Court private residence, Conference Hotels Limited in Sagamu, and its annex—all of which the government alleges were built without proper planning permits and required setbacks.
Judge: ‘Immediate intervention necessary’
In granting the ex parte orders, the court restrained the state, its “agents, allies, proxies, assigns, cronies, servants,” and anyone acting on its behalf from enforcing the quit notices, carrying out demolition, or interfering with Daniel’s quiet possession of the properties.
The disputed Asoludero Court property spans about 1.659 hectares within the Government Reservation Area (GRA) Sagamu, covered by Certificate of Occupancy No. LUD3/LR2693 issued on January 20, 2010.
“I am satisfied this Honourable Court needs to intervene urgently,” the judge ruled, stressing that the order would stand until the hearing of the substantive motion on notice.
Multiple suits, same outcome
In related suits filed by Conference Hotel Limited and Blue Chapel Limited, the court issued similar injunctions, halting any demolition or tampering with the properties in question, which have separate Certificates of Occupancy dated April 8, 2004.
The state government’s quit notices cited “suspected” construction without permits, but Daniel’s camp has maintained that all necessary approvals were secured.
The matter has been adjourned to August 19, 2025, for hearing on the application for an interlocutory injunction.
