The Office of the Attorney-General of the Federation (AGF) and Minister of Justice has clarified that no inmate approved for presidential clemency has been released from custody, noting that the process remains under final administrative review.
The clarification follows public backlash over President Bola Tinubu’s recent exercise of the power of prerogative of mercy, which granted pardon to certain categories of inmates.
In a statement personally signed on Thursday by the Attorney-General of the Federation and Minister of Justice, Prince Lateef Fagbemi (SAN), the Office said the process is still at the final stage — which includes a standard verification procedure to ensure that all names and recommendations comply with legal and procedural requirements before any release order is issued.
“It is important to note that the last stage of the exercise, after approval by the Council of State, is the issuance of the instrument for the implementation of the decision concerning each beneficiary,” Fagbemi stated.
“This stage affords an opportunity for a final look at the list for remedial purposes, if any, before the instrument is forwarded to the Controller-General of Corrections for necessary action.”
Fagbemi emphasized that the verification process reflects the government’s commitment to transparency, accountability, and due process.
He also appreciated the public’s vigilance and feedback, describing it as a sign that Nigerians care deeply about justice and good governance.
“There is no delay in the process; it is simply following the law to the letter to ensure that only those duly qualified benefit from the President’s mercy,” the AGF added.
“As soon as all legal and procedural checks are concluded, the public will be duly informed. The rule of law does not rush; it ensures fairness.”
Last week, the Council of State ratified a list of offenders — including those serving prison terms, on death row, or already deceased — as beneficiaries of the presidential pardon presented by President Tinubu.
However, the development has sparked sharp criticism from the public, particularly over reports that individuals convicted of serious crimes, including murder and drug-related offenses, were among those granted clemency.
One notable name that drew widespread attention was Maryam Sanda, a death-row inmate convicted of killing her husband.
Fagbemi’s clarification now indicates that no inmate, including any of the controversial names mentioned, has been released, as the verification process is still ongoing.
