Australian Designer Wins Trademark Battle Against Katy Perry

Australian fashion designer Katie Perry has won the right to sell clothing under her own name, ending a years-long trademark dispute with US pop superstar Katy Perry.

The legal battle began when the designer claimed she had established the “Katie Perry” brand before the singer rose to international fame. The singer argued that her music had already gained global recognition by 2008, when the designer began selling clothes, and sought to cancel the trademark in Australia.

In 2024, an Australian court sided with the singer, ruling that the clothing trademark should be revoked. However, the High Court of Australia has now overturned that decision on appeal, ruling in favor of the designer and concluding there is minimal risk of public confusion between the two.

A spokesperson for Katy Perry told AFP that the singer “has never sought to close down” the Australian business, underscoring that the ruling does not affect her music career.

The decision allows the Australian designer to continue operating under her own name while drawing a clear legal distinction between her fashion brand and the pop star’s global persona.
