Court orders Omiwole ruling house to produce Obalufon of Sepeteri

An Ibadan high court has ruled that the Omiwole Ruling House and not any other family should present the next candidate to the vacant stool of traditional ruler (Obalufon) of Sepeteri ,a town in Saki East Local Government area of Oyo State.
Justice Ezekiel Olayinka Ajayi while delivering the judgement in the case made a declaration and granted the Chieftaincy Declaration made pursuant to section 4(2) of Chiefs Law of 1957 approved on 26th October, 1959 and registered on 28th October, 1959 is subsisting valid and the contents thereto are the customary law and practice duly accepted and recognized by all and sundry in Sepeteri.
The claimants in the case includes Prince Omiwole Oyinwola Imuraina and Prince Oniwole Oyeleke Moruff, for themselves and on behalf of Omiwole Oladosun Ruling House.
While the defendants includes the Executive Governor of Oyo state, the Commissioner for local government and chieftaincy matters, the Attorney General and Commissioner for Justice, the Chairman, Saki East Local Government, the Alaafin of Oyo, Oba Lamidi Olayiwola Aderemi 111 ,Chief Ganiyu Olaniyan( the Agoro of Sepeteri for himself and kingmakers of Obalufon of Sepeteti).
Others includes Prince Hamed Olayiwoyin Oyediran, Prince Titilola Olaleye, Prince Olaleye Olawoyin, Prince Olaleye Bolanle Ahmed.
Justice Ajayi held that though Adesola family may be in existence in Sepeteri, the only 3 ruling houses recognized by the people of sepeteri and the Chieftaincy declaration regarding the filling of the vacant stool of Obalufon approved on 26th October, 1959 and registered on 28th October, 1959 are Omiwole, Adesola and Alao Alatise ruling houses.
The judge further granted the order quashing and set aside the letter written on behalf of the 4th defendant dated 26th July, 2013 by Prince A. O. Apanpa ref. no SELG/T/112/88 to an unspecified family head of Omiwole ruling house, Sepeteri requesting Omiwole family to meet and nominate candidate to fill the vacant stool of Obalufon of Sepeteri having been wrongly delivered and not directed to a specific head of family.
Justice Ajayi also granted an order commanding 1st to 4th defendants to write another letter to Prince Omiwole Oyinloye imuraina, the current head of Omiwole ruling house, requesting them to meet and nominate candidate to fill the vacant stool of Obalufon of Sepeteri pursuant to the said chieftaincy declaration of Sepeteri.
An order of this court is granted quashing and declaring null and void the letter written by Mr. M. O Akano dated 25th October, 2013, ref. no. CB. 141/25/9/vol.11T/54, purportedly to have been written on behalf of the commissioner for local government and chieftaincy matters when in truth and fact there was no commissioner to approve as at 14th October, 2013 up till time the letter with ref.no.CB.141/25/9/vol.11T was written and same being in conflict with the provisions of chieftaincy declaration of 1959 recognized to fill the vacant stool of Obalufon of Sepeteri.
